CAS position declared unconstitutional

    The High Court in Nairobi has declared that President Uhuru Kenyatta's creation of the position of Chief Administrative Secretaries in all government ministries was unconstitutional. High Court Judge Anthony Mrima on Tuesday also said Cabinet Secretaries who were appointed in the first term must be approved by the National Assembly to serve in the second term. He added that any Permanent Secretary not competitively recruited by the Public Service Commission is in office illegally. Justice Mrima further however gave a 30 days appeal notice to allow the Attorney General to file an affidavit on the ethnic and gender composition of the cabinet. The petition filed by activist Okiya Omtatah was challenging the creation of the offices of CAS and the appointment of officers in the office without competitive recruitment.
