Court dismisses petition over disappearance of Mwenda Mbijiwe

    It was a major setback for the family of missing security analyst Mwenda Mbijiwe after the High Court dismissed a petition seeking to hold state agencies responsible for his disappearance. In its ruling, the court found that the petitioners had failed to provide sufficient evidence to prove that Mbijiwe went missing while in the custody of state agencies. Justice Martin Muya noted that although the family had established that Mbijiwe was arrested by police officers before his disappearance, they did not demonstrate that he remained under the legal custody or control of the respondents thereafter. The judge further held that the burden of proving such custody rested with the petitioners
