The government now has an open cheque to deal with the flood crisis by spending without approval by parliament courtesy of Article 223. This comes even as fears of misuse of the article remain after auditor general Nancy Gathungu warned that it risks providing a parallel budget which could force the country to borrow leading to an ever-increasing public debt. Budget chair in the national assembly Ndindi Nyoro has urged the treasury to release funds without approval from parliament to mitigate the floods, a move which potentially could bring to over 2 trillion kenya shillings withdrawal of public money without approval in the last 9 years.
