Former President of the Law Society of Kenya, Nelson Havi, now wants the three-judge bench constituted to hear a petition seeking the removal of Chief Justice Martha Koome and the six other Supreme Court judges disbanded. In a Certificate of urgency, Havi has given numerous reasons for his application calling for a new bench to be appointed. The three-judge bench comprising Justices Charles Kariuki, Lawrence Mugambi, and Bahati Mwamuye also had a hard time explaining why a matter touching on the Chief Justice was given an October date hearing rather than an earlier date. The Supreme Court judges are accused of violating the Constitution and the Judicial Code of conduct.
