The lawyers had sought to delay the hearing of an application because the court of appeal had not yet determined the appeal filed by the petitioners, challenging the empanelment of the three-judge bench, which was constituted by deputy chief justice Philomena Mwilu. The parties involved have been given time to amend their applications and file responses, with a date set for February 27th for further mentions and directions.
