Justice Mwamuye bars government from implementing the National Infrastructure Fund

    The High Court has issued orders stopping the government from implementing the proposed National Infrastructure Fund, pending the hearing and determination of the case. The orders were issued by Justice Bahati Mwamuye on Wednesday evening following successful petitions by Nakuru-based surgeon Dr Benjamin Gikenyi, Eliud Matindi and others who are challenging the establishment of the National Infrastructure Fund through a presidential directive dated 15th December 2025. The petitioners argue that the executive action threatens constitutional principles, including supremacy of the Constitution, prudent use of public resources, transparency, accountability, and public participation.
