Justice Anthony Mrima: Rigathi Gachagua sought a declaration that the Senate proceedings violated his constitutional rights to personally defend himself. They unreasonably declined to adjourn the impeachment process despite being informed of his illness and admission in Karen hospital. Furthermore, the Senate acted in breach of the constitutional rights of fair hearing, procedural fairness and natural justice.
