Former Cabinet Secretary Raphael Tuju wants court to stop police from arresting him

The Court will tomorrow determine whether former Cabinet Secretary Raphael Tuju will take a plea in absentia or not. Kibera Law Courts Chief Magistrate Stella Atambo will also rule on whether the former Jubilee Party Secretary General will be issued with a police bond, pending his arraignment. This is after Tuju’s defense lawyers, led by senior counsel Kalonzo Musyoka, differed with the prosecution over whether the magistrates’ court has jurisdiction to preside over the case. The courts also granted Tuju 7 days to seek comprehensive medical care. Tuju was transferred to Karen Hospital, where he remains under continuous police guard, despite not being formally charged. The former CS argues that such custodial control in a hospital setting is inhumane and violates his right to liberty and medical care.
